The Max Planck Handbooks In European Public Law

by Armin von Bogdandy, release date 2020-02-27, The Max Planck Handbooks In European Public Law Books available in PDF, EPUB, Mobi Format. Download The Max Planck Handbooks In European Public Law books, The Max Planck Handbooks in European Public Law describe and analyse public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, the series aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. The first volume of the series began this enterprise with an appraisal of the evolution of the state and its administration, offering both cross-cutting contributions and specific country reports. The third volume (the second in chronological terms) continues this approach with an in-depth appraisal of constitutional adjudication in various and diverse European countries. Fourteen country reports and two cross-cutting contributions investigate the antecedents, foundations, organization, procedure, and outlook of constitutional adjudicators throughout the Continent. They include countries with powerful constitutional courts, jurisdictions with traditional supreme courts, and states with small institutions and limited ex ante review. In keeping with the focus on a diverse but unified legal space, each report also details how its institution fits into the broader association of constitutional courts that, through dialogue and conflict, brings to fruition the European legal space. Together, the chapters of this volume provide a strong and diverse foundation for this dialogue to flourish.

The Interface Between Eu And International Law

by Inge Govaere, release date 2019-05-16, The Interface Between Eu And International Law Books available in PDF, EPUB, Mobi Format. Download The Interface Between Eu And International Law books, Despite their many obvious interconnections, EU and international law are all too often studied and practised in different spheres. While it is natural for each to insist on its own unique characteristics, and in particular for the EU to emphasise its sui generis nature, important insights might be lost because of this exclusionary approach. This book aims to break through some of those barriers and to show how more interaction between the two spheres might be encouraged. In so doing, it offers a constitutional dimension but also a substantive one, identifying policy areas where EU and international law and their respective actors work alongside each other. Offering a 360-degree view on both EU and international institutional and substantive law, this collection presents a refreshing perspective on a longstanding issue.

Criminal Law And Policy In The European Union

by Samuli Miettinen, release date 2013, Criminal Law And Policy In The European Union Books available in PDF, EPUB, Mobi Format. Download Criminal Law And Policy In The European Union books, "A literal construction of the EC and EU Treaties suggests that their framers intended to limit the positive competences of both the Community and the Union in the field of criminal law. However, the European Court of Justice has consistently applied tests of necessity and effectiveness to develop the Community's catalogue of legislative competences and the interpretation of Community law, culminating in decisions which accord to the Community a limited criminal competence where this is deemed necessary for the effectiveness of other policy aims. This book takes stock of the development of criminal law in the context of the European Community and the European Union, and examines whether this has led to a European criminal policy, and interrogates the legal effects that European-level initiatives in the field have on national criminal law and on suspects. The work reflects on the interaction between the law of the European Community and national criminal law since the signing of the Treaty of Rome and proceed to consider the prospects of criminal law enacted at the European level against this framework of historical development. The book will review the supremacy of Community law over conflicting national criminal law, the past legislative practice of harmonised 'administrative' penalties and their impact on national legal systems, the ramifications of the Greek Maize decision, the development of relevant Community principles of fundamental rights, and the 2005 decisions on implied criminal competence and sympathetic interpretation. In the light of these developments and the judgment of the Court of Justice in the Ship-Source Pollution case, the work will explore whether there are fields in which the Community might enact directly applicable criminal penalties in the form of EC regulations. It will also examine related doctrinal concerns considered by the Court of Justice in its earlier case law on the interface between EC law and national criminal law. "--

Employment Law And Human Rights

by Robin Allen, release date 2007, Employment Law And Human Rights Books available in PDF, EPUB, Mobi Format. Download Employment Law And Human Rights books, This new edition of Employment Law and Human Rights brings practitioners up to date with the continuing practical impact of the Human Rights Act 1998 in the employment field. Human rights issues have become increasingly prevalent in employment cases, and significant new equality legislation has been introduced. A thorough understanding of the area is now vital for the serious employment lawyer. The text considers in detail all aspects of the European Convention of Human Rights in an employment context, with a particular focus on areas which have developed most rapidly in recent years. It looks at the complex regulatory framework surrounding privacy at work, data protection and internet access, and the various new surveillance regulations, and considers these in the light of the UK's Convention obligations. It also considers in depth the overlap between the implications of the Human Rights Act and the new equality laws relating to religion and belief, sexual orientation, and age, in addition to issues arising from existing discrimination legislation. The book marries expert commentary on the background legal themes with comprehensive practical guidance on current law and procedure, including the controversial topic of public funding. Throughout the book ECHR jurisprudence is considered and cross referred to domestic case law, and each chapter contains a "Frequently Asked Questions" section to assist the busy practitioner. Written in a clear and accessible style, and designed for ease of reference, the book is essential for lawyers, specializing in employment law, employment law advisers, Employment Tribunal chairmen, and human resources officers.
